Linux Patent Protection Network Gets Boost From Facebook, HP…As Others Intensify Linux War

Facebook, HP, and the OpenStack project have joined the Open Invention Network (OIN), a consortium of organizations intent on protecting Linux and related open-source software from legal attack.

 

Few days ago, the OIN announced that in the first quarter, 74 new organizations joined its “community” as licensees, including Fujitsu, Rackspace, and Juniper as well as Facebook, HP, and OpenStack, the latter of which is an open source “build-your-own-cloud” group co-founded by Rackspace. Licensees agree not to use their Linux-related patents against each other, and they receive free access to a collection of additional patents purchased by the consortium as a whole.

 

The OIN was founded in 2005 by IBM, NEC, Novell, Phillips, Red Hat, and Sony. It now owns 300 Linux-related patents, and through its licenses, it has access to more than 2,000 others. The idea is to allow its members to continue to “innovate” atop Linux without worrying about the threat of patent-related lawsuits. Google is also an OIN member. In 2007, it became the organization’s first “end-user licensee”, meaning it didn’t sell, distribute, or develop Linux code. At the time, it only used Linux within the company. But it has since launched Linux-based products such as Android and Chrome OS.

 

The irony here is that Oracle is a member as well. In signing the OIN’s royalty free licensing agreement, members vow not to assert their patents against what’s called “the Linux System”. But this didn’t stop Oracle from suing Google over its use of Java in Android, which is built on the Linux kernel.

 

Even before Oracle’s suit, patent watcher Florian Muller and others criticized the organization, saying it doesn’t really provide the type of protection you might assume that it does. “I’ve always said that there’s no evidence it has ever helped any company (the latest example is Salesforce, which apparently pays royalties to Microsoft for a variety of patents including some that rely on Linux)…The OIN doesn’t truly protect all of FOSS but only an arbitrarily defined list of program files,” Muller said when Oracle’s suit arrived.

 

“Oracle’s lawsuit against Google is the strongest evidence that my concerns about the Open Invention Network are well-founded. Both Oracle and Google are OIN licensees, so in theory there is a non-aggression pact in place between them, but everyone can see that Oracle sues Google anyway because the OIN’s scope of protection is too narrow.”

 

Paradoxically, Google — which is fighting lawsuits against Linux-based Android — is moving up from licensee status to an associate membership, joining Canonical of Ubuntu Linux fame as the only companies with the second-highest level of OIN membership. Yahoo also joined as a licensee late last year. One major threat to Linux — the SCO vs. Novell case — has gone by the boards since the Open Invention Network was founded, but threats remain, according to OIN CEO Keith Bergelt.

 

Microsoft hasn’t pursued its claim that Linux and open source software violate 235 Microsoft patents, but “behind the scenes, they’re still very active,” Bergelt said. If Windows desktop market share ever erodes, Microsoft could become more lawsuit-happy. “They will continue to represent a potential source of antagonism toward Linux,” he said.

 

But Microsoft is not the only company that potentially threatens Linux, according to Bergelt. “It’s really just anybody who supports proprietary platforms and has a large [patent] portfolio that it likes to continue to use to be able to discourage choice,” he said. “There will always be those who will be looking at Linux potentially threatening their livelihood, their way of life.”

 

The OIN’s goal is not to prevent legitimate use of patents to secure royalties when others infringe upon inventions, Bergelt said. The goal is to foster an open environment in which people can innovate without being subjected to frivolous claims, and prevent the tech industry form being dominated by “incremental innovation, which is a euphemism for mediocrity,” he said.

Google Day Nigeria – The Summary of Day 1 Program

Yes, finally, the Google Day Nigeria took place, today.  The program was tweeted live by the fans of Google in Lagos – the Nigerian commercial capital city. Unfortunately for those that expected to participate and master all the acts of developing on Android, Chrome, sorry.  You still need to come to Fasmicro and learn Android!

 

Google is in Nigeria to sell its products and make money. But they are doing something great- empowering people. They are doing that but that was not what we really saw – empowerment will come tomorrow. Today, it was content to own the mobile and web ecosystem of Nigeria. The eyes are on Blackberry and I pity them. Sorry BB, you will be history soon if Google has its way. The energy, the interest and enthusiasm means the end of BB has cone in Nigeria. I have never seen a technical program that interested young men in Nigeria like this one!

 

Guys came in time and by early morning, it was agog with business. No African time – these boys know when to get up in time for business. They were here even before the registration people. It is boys in and there were many -indeed in 100s. It is estimated to bring up to 1000 guys before the event ends tomorrow. One will wish that Nigerian government will use Google to recruit talented minds to embrace engineering and we can fix that nation.

 

Nigeria should be very lucky that Google could find that number of developers in the nation. Good job Google and thanks for coming.

 

We took our seat waiting to learn the developing aspect of today’s event.

 

Then the keynote came – it was the best part of the day to me. It was delivered by the Country Manager, Juliet

 

She is my very own person from my part of the world; it was good seeing her live. Her statistics are not mind blowing. 180m people using Google in Africa – about the size of Nigeria. What happened to the other 4/5 of Africa? Then the good one – 380m mobile users in Sub-Sahara Africa. That was the one that got me excited because I was holding a copy of Ovim tablet. And then the dull one 91m internet users.

 

Let us summarize:

180m using Google in Africa (perhaps SSA)

380m mobile users in SSA

91m internet users (perhaps SSA)

 

What this means is that more people are using Google than internet in Africa and most likely they are going through another channel. I tried to figure out how more people will use Google than internet because Google lives on Internet. Immediately, I noticed that I might have got the numbers wrong in all the fun I had. Please do not quote these numbers as I am not sure. Oh yes, it is possible that more people can use Google because there many ways to get into Google than Internet? I need training!

 

Then she continued – 4m Youtube page view per day in Africa. That is awesome. How many of that translated to wasted man hours watching dancing feathers?

 

Simply, she got into business – Google wants contents and Nigerians should help to provide those contents.

 

Google was concerned about cost of bandwidth and is open to help Nigerians get online. Thanks Google for that – we need any help we can get. Some schools were mentioned – UNILAG (of course), UNN, Covenant University and others are part of the Google Nigerian University program.

 

Google is open to partner with developers and will not leave Nigeria until it has made all the money it needs in Nigeria. Google has been right, even from MTN, people are searching via their mobile devices and this has gone around 100% per year growth.

 

There was an introduction meeting on Android, API, Chromse, HTML5 and Google Maps. There was the emphasis that Google will launch some new products like Classified ads, Google Trader, etc. Google is really customizing its solutions to work for Nigerian terrain. Gmail SMS works on Starcomms and Glo. If you are building classified Ad business, get out now. Google is here. Period!

 

The only bad news was the delay in lunch. On a scale of 1 to 10, we rate Google 9. Why? They were able to prove that young Nigerians love technology and if you make it exciting they will come. Government, ask Google what the secret is. They made us all like to be known as developers.

 

Tomorrow lunch will be better because the business people are coming. Of course, I am also in. Hope they will not kick me out.

Signal Alliance Nigeria Expands Management Board

Leading information technology systems administrators and integrators, Signal Alliance has issued a statement announcing the expansion of its management board with the inclusion of a seasoned journalist and administrator, Mr. Emmanuel Agu and Mr. Lanre Onasanya as new members.

 

The announcement, which was issued from the Lagos head office of the group which includes Signal Alliance Limited and Dynamic Tribe limited. Describing the move as a “strategic move to consolidate the overall value and impact of the firm in the Nigerian and regional market”, the managing director of the firm, Collins Onuegbu explained that the individual experiences and corporate management insights of both candidates, gave them the qualification to be a part of an ambitious company like Signal Alliance.

 

One of the new board members, Emmanuel Ifeanyichukwu Agu is best known for his two decades-long career at the Champion Newspapers Limited where he rose from pioneer editor of the Daily Champion in 1988 to Group managing Director in 2008 when he voluntarily disengaged from the company. He is currently the CEO of 3G Media Network Limited and publisher/editor-in-chief of Zest INTERNATIONAL magazine and Zest DAILY newspaper.

Prior to joining Champion Newspapers, Mr. Agu had climbed the professional ladder at the Imo State Government-owned Statesman group from staff writer on joining in May 1985 to Editor of the daily, The Statesman in 1988. A widely traveled journalist, Mr. Agu has remained faithful to his professional calling except for a brief period in 1993 when he served as chief press secretary to Chief Ernest Shonekan, Head of the Interim National Government, ING in Nigeria.

 

Mr. Agu is an alumnus of the University of Ibadan from where he obtained a B.Sc. Honours degree in political science in 1981. He also holds the M. Sc. in International Relations and Strategic Studies (1984) of the University of Jos. Mr. Agu has attended several courses in Nigeria and abroad under the auspices of the International Press Institute (IPI) and the Commonwealth Press Union (CPU) which took him to Spain, Switzerland, Russia, and Australia. Between 2001 and 2006, he was General Secretary of the Newspaper Proprietor’s Association of Nigeria (NPAN). He is Fellow of the Nigerian Union of Journalists (FNUJ) and the Nigerian Guild of Editors (NGE).

 

On his part, Lanre Onasanya, a business development practitioner with a strong focus on technology driven solutions, will be bringing his wealth of experience to bear. Mr. Onasanya has a Masters in Business Administration with a specialization in Marketing. He has completed several trainings in the areas of management, sales, marketing and intellectual property.

He is currently the Lead Consultant for Africa and the Middle East for McGhee Productivity Solutions USA, where he oversees the business in the regions, with a presence in Kenya, Nigeria and South Africa. McGhee Productivity Solutions provides leading companies and not-for-profit organizations, the innovative action-management strategies and products they need to improve executive and employee performance.

 

Lanre Onasanya is also the CEO of Integral Assets Limited, a company with presence in Kenya, South Africa and Nigeria. Integral Assets aims to leverage human resource capacity and technology across the African continent for growth. He started his career in the financial services industry and subsequently led sales teams in logistics/courier companies before his foray into the Information Technology sector as a Business Development Manager in Resourcery Plc, Nigeria. He was a key part of the pioneer team that set up Microsoft Nigeria before his transfer to the Regional Headquarters of Microsoft in South Africa.
