Jodie Turner-Smith and Joshua Jackson have set aside their legal dispute. The Dawson's Creek star and Tron: Ares actress have canceled their trial regarding custody of their 5-year-old daughter Juno, five months after the couple struck a deal in their divorce.
In a court filing submitted by her legal team on October 14, Jodie, 39, asked that the trial dates scheduled for October 15, 17, & 22 "be hereby taken off calendar." According to the petition, she and Joshua, 47, are negotiating a new custody arrangement for Juno that does not call for a trial.
“The parties are in the process of negotiating a custody judgment,” the document says. “The parties will return to the privately compensated temporary judge to resolve any impasses in the proposed custody judgment.”
Representatives for Jodie and Joshua have been contacted by news organizations, but they have not responded.
Joshua filed a motion on May 30 asking for an emergency custody order modification, continuing the legal battle even though the two had originally agreed to maintain "the existing temporary joint legal and physical custody orders, awarding joint legal and physical custody to the parties with equal timeshares" in their May divorce settlement. At the time, he claimed that Jodie had enrolled Juno in a different school with his consent, one that was 45 minutes away from his home.
"Respondent respectfully requests orders ensuring that the minor child continues attending her present school for the next academic year 2025-2026,” the documents obtained reads, “and for the parents' joint consent to be required for any subsequent school change."
In addition, the Doctor Odyssey star stated that he was worried that the Queen & Slim actress was “attempting to create a scenario where Juno travels with her rather than attending a traditional school,” pointing out that Jodie frequently shoots in London throughout the year and had texted Joshua that their daughter might benefit from tutors and online education.
Letters from Joshua and Jodie safeguarding their allocated time with Juno were involved in his motion.
“I'm also glad we agree that our shared goal is to provide Juno with as much stability, consistency, and meaningful time with both of us as possible,” on May 23, Jodie, 38, wrote Joshua a letter. “I hear and appreciate your point that this is ultimately her time with each of us, and not the other way around. That framing feels important.”
Furthermore, the Acolyte actress, who first filed for divorce from Joshua in October 2023, asked Juno to spend five weeks with her during the summer in Europe. In a statement dated May 26, Joshua, however, voiced his worries, stating that the arrangement would require him to miss Juno for four weeks.
“I think that maximizing that frequent, continuing and meaningful contact should be our guiding light through all of these conversations and planning of parenting time,” he published. “Juno needs both of us. Ideally exactly equally.”
Also, he asked Jodie to speak with him about Juno's vacation plans before sharing them with their daughter in order to “save her confusion or disappointment.”
As the Mighty Ducks star pointed out, Jodie and Joshua have faced challenges, but they both want to give their kid the greatest life possible.
"It's my job," he stated in a Dinner's on Me podcast episode from April, which was hosted by Jesse Tyler Ferguson, "shared with my ex-wife, to do everything that we can to nurture you, cultivate you and give you all the tools that you need in life."
He went on, "If I ever did anything to estrange my daughter from myself, I would be in duress. I actually can't conceive of it because I don't even wanna think of the pain that that would be."
