It is always the most fascinating season: the graduation week in Tekedia Institute. Many express their feelings and appreciations for the excursions we have taken them. We run the only school in Africa with a major investment unit. Pranks: The Legal consequences in Nigeria

A lab technician by the name, Kevin Berlin who worked at Gravity Diagnostics in Covington, Kentucky, USA in 2019 warned his colleagues that due to his medical condition of anxiety disorder and panic attacks he really didn’t want his colleagues to prank him at any time or organize any type of surprise birthday celebration party for him on his birthday which is the company’s tradition.

The company despite Kevin’s warning went ahead and pranked him and threw him a surprise birthday party and as a result of the prank and surprise party, Kevin did indeed experience a panic attack and anxiety disorder just as he told them earlier.

Kevin sued the company for damages and won the lawsuit and the company was mandated to pay him $450,000 as compensation for the damages he suffered.

This above incident just points to the fact that although pranks can be harmless and for entertainment purposes but if any harm is suffered by the victim be it mental, physical, emotional, or psychological, the prankster risks getting prosecuted for criminal or civil liabilities or even both.

The fact that we laugh at pranks or get entertained by them does not mean that some of these pranks can not land both the victim and the prankster in deep trouble. 

These pranks whereby the pranksters chase people around with fake guns, charge to beat up the victim, or advance to attack the victim all in the name of pranks put the victims’ lives at risk. People who suffer from an anxiety disorder, panic attacks, cardiac arrest, or any other medical conditions can get triggered as a result of it and this could lead them to serious medical conditions or even death. Those that are medically fit that decide to run as a result of the prank can miss their steps, fall, and sustain injuries.

pranksters don’t just stop by pranking the unsuspecting victims, they also go further to record the victim and post it online without the victim’s permission or consent thereby breaching the victim’s right to privacy and some go as much as invading their victim’s privacy just to prank him or her.

The act of recording the victim and posting them online without the victim’s knowledge or consent can be grounds for the prankster to be criminally prosecuted for the breach of privacy and invasion of the privacy and space of another. 

Other criminal actions that may arise as a result of these pranks include; harassment, stalking, disruption of the public peace, constitution of nuisance, etc. 

In the worst-case scenario, if the victim of the prank dies as a result of the prank, it does not matter in law that the prankster did not mean it to go that way, the prankster will be prosecuted for involuntary manslaughter. 

Involuntary manslaughter has been defined as the unintentional death of an individual as a result of another person’s negligent actions. Basically, what it means is killing someone and not realizing your actions could cause death. ‘Unintentional’ is the keyword for involuntary manslaughter because the person did not mean or intend to kill the deceased and the Punishment for this crime as provided in S 325 of the criminal code act is life imprisonment. 

Even when criminal charges cannot be established against the prankster, the victim can trump up civil actions against the prankster for assault and battery or tort of negligence or sue for compensation if the victim suffered any loss or damages as a result of the prank. 

On this note, pranksters should desist from engaging in reckless pranks that put lives in danger and if they must, they should exercise due diligence and caution as they go about their crafts bearing in mind that huge legal consequences await them if their victim suffers any damage or decides to sue for civil liabilities and citizens should also know that they have rights of action against pranksters who have taken undue advantage of them to sue them for compensation for loss or injury they suffered as a result of the prank.  

Most importantly, pranksters should know or be reminded that some people go about with hidden medical conditions and not everyone they meet is medically fit, a person can die as a result of some of these pranks and if that happens, it will be presumed in law that the prankster has caused the death of the victim and he will be prosecuted for manslaughter.

OSUN 2022: What PDP Promised Voters During Iwo Campaign Rally

PAN is a group of academics and independent researchers dedicated to maintaining a favuorable environment for Nigeria’s socioeconomic and political activities. With the issue of the candidacy of the People’s Democratic Party (PDP) in the upcoming Osun State gubernatorial election still a subject of litigation, the candidate of the party recognized by Nigeria’s election management body (EMB), Senator Ademola Adeleke flagged off his governorship campaign in Iwo town, the political headquarters of the Osun West Senatorial constituency; the electoral district that the Ede-born politician represented in the upper chamber of Nigeria’s federal parliament between 2017 to 2019 following the death of his brother, Senator Isiaka Adetunji Adeleke who was occupying the seat until his demise.

Shortly after arriving the ancient city, the governorship candidate and his entourage proceeded to the palace of the Oluwo of Iwo, His Royal Majesty Oba Abdulrasheed Adewale Akanbi, Telu 1 for royal blessings ahead of the campaign rally. Oba Akanbi thanked Senator Adeleke and the PDP for giving Iwo the honour of hosting the maiden campaign of the party for the July 16, 2022 election. He prayed for the success of the party and the candidate in the election. Senator Adeleke and the campaign team then headed for the venue of the campaign rally at the Oluwo Palace Square.

Addressing the huge crowd that attended the rally, Senator Adeleke said he is on a mission to reposition the 31-year-old state once he assumes office as governor in November this year. Berating the successive All Progressives Congress (APC) governments in the state, Senator Adeleke said it is no longer acceptable to see Osun people suffer infrastructural neglect and economic hardship. In the words of the former federal lawmaker: “while making our way here, we saw deplorable state of the roads and try to imagine the kind of pains that people go through using them every day”. While insisting that these pains are needless and avoidable, Senator Adeleke pledged that “I can promise you that as your Governor, I will not allow this experience to continue as I will fix all bad roads”.

Speaking specifically on the bad condition of the Iwo-Osogbo road, Senator Adeleke rejected the explanation of the APC administrations on the status of the 57.6 km road. According to him, “Let us even assume it (APC administrations) is right that the road belongs to the federal government, does that stop them from pooling up resources to put it in a good condition to take away the pains Osun people daily suffer using that road and unlock the economic potentials it holds?”

Senator Adeleke also took a swipe at the Oyetola administration for what the former Senator called the insensitive manner in which the administration handles the welfare of government workers and pensioners in the state. While lamenting the hardship that retired civil servants are going through due to late payment of their entitlements, the PDP candidate affirmed that “me and my party is totally against this and will see to it that no one is denied their entitlements”.

Undertaking an assessment of the social sector of the state, Senator Adeleke scored the APC government low on education and health sectors. He described the bursary and scholarship programmes of the APC government as a deceit promising to pursue educational policy “that will truly improve education, not the cosmetic ones we have now. Teachers will get their entitlements as at when due, and we will support them with regular training as well as equip schools with the right tools that impact the right learning on students”. On health, he promised that if elected, his administration will “be deliberate in investing in the healthy being of Osun people by equipping healthcare centres and hospitals with what is needed to attend to the health need of the people”.

Also speaking at the rally, the Director General of the Ademola Adeleke Campaign Organization (AACO), Honourable Sunday Bisi cautioned against rigging in the July 16 election warning that the PDP will strongly resist any form of irregularity during the election. He expressed confidence that from what he has seen so far across the state, Osun people would elect Senator Adeleke as governor in July.

The PDP should be commended for the zero violence recorded during the campaign rally in spite of pre-rally fears. While the uncertainties of the outcome of the litigation against his candidacy stares him in the face, Senator Adeleke will take his “rebuilding” message to other senatorial constituencies in the state hoping to convince Osun voters to trust him with their mandate in the July 16 gubernatorial contest.

Elon Musk Says Twitter Might Charge Companies, Government Officials To Use The App

Not too long after purchasing the microblogging platform, Twitter, Billionaire entrepreneur Elon Musk recently disclosed that Twitter commercial and government users may likely have to pay to use the platform.

After he purchased the platform, there were concerns from users stating that his takeover might lead to the monetization and commercialization of the social media platform.

Just recently after he disclosed in a tweet stating that commercial and government users will pay for the platform, he has however doused the fear of many users, by disclosing that the microblogging platform would always remain free for casual users.

In a bid to justify his move to commercialize the platform for commercial and government users, he revealed in a series of tweets that free services in the past were what led to the downfall of great businesses.

In a tweet, he wrote, “Twitter will always be free for casual users, but maybe a slight cost for commercial and government users”.

In a reply to the tweet, he wrote, “some revenue is better than none”. He wasn’t done yet, as he further went on to tweet about what led to the downfall of the freemasons, which he wrote, “Ultimately, the downfall of the Freemasons was giving away their stone cutting services for nothing”. 

Musk also suggested that the micro-blogging platform, Twitter, may charge publishers a fee to embed tweets, as he wants to steer Twitter towards subscription revenue and away from advertising. He revealed that the revenue Twitter generates is mainly derived from advertising, rather than its user base, which has been disclosed that it is not large enough to make up for its finances.

Looking at how visionary Musk is and his desire to succeed, it is quite obvious that there will be a paradigm shift as regards the monetization of Twitter. Musk could be looking to accelerate user growth as well as the advertising revenue, or probably add new features to the platform for it to generate more revenue.

One thing for sure is that even if the Twitter business may not be his concern, the billionaire entrepreneur will not want to be on the losing side, as he will seek strategies to generate more revenue for the micro-blogging platform.

He had earlier disclosed his plan to eliminate the salaries of Twitter’s board of directors, which he said could result in about $3 million in cost savings. Recall that Musk had to secure loans to purchase the platform, where he disclosed to banks his plan to develop features to grow the business revenue, including new ways to make money out of the tweets that contain important information or go viral.

I strongly have the inkling that Musk will monetize some features on the platform in the long run, because of how low it generates revenue compared to other platforms.
