Aviation Law :- The Regulatory Framework Governing The Safe Transport Of Dangerous Goods By Air

Air travel and transportation are not without their risks which might be significantly heightened when the safe conveyance of dangerous goods by air is involved. This is the basis in Nigeria through the Nigerian Civil Aviation Authority (NCAA) creating a regulatory framework governing the transport of such goods by air.

The notable provisions of this regulatory framework will be the focus of this article.

Scope & Subject Matter 

– The NCAA Regulations establish the regulatory requirements for the management and safe transport of dangerous good by air in civil aircraft.

– The rules set forth in this Part apply to both international and domestic commercial air transport operations.

Applicability

– The requirements of this Part shall be applicable to both domestic and international operations of civil aircraft.

-This Part prescribes the requirements of the Federal Republic of Nigeria that apply to the carriage of dangerous goods by air as specified in the International Civil Aviation Organization Document, Technical Instructions for the Safe Transport of Dangerous Goods by Air and all applicable amendments; and 

– To any person who performs, intends to perform or is required to perform any functions or activities related to the transport of dangerous goods, including:

1). The air operator in:

(i) Aerial work;

(ii) Commercial air transport;

(iii) General aviation; and

Any person responsible for the delivery or acceptance of air cargo;

2). Crews and employees, including contracted personnel who receive cargo, passengers and baggage or who handle, load and unload cargo;

3). The passenger of the air transport who carries any dangerous goods with him or in hand luggage or dispatched; an

4). The manufacturer and assembler of packaging for the air transport of dangerous goods.

5). Any instructions or limitations contained in the Technical Instructions for the carriage of dangerous goods on passenger or cargo aircraft, as therein defined shall for the purpose of this Part be interpreted as applying also to the carriage of such goods beneath passenger or cargo aircraft.

Definitions

For the purpose of the Regulations, the following definitions shall apply

– “Approval”:-An authorization granted by an appropriate national authority for:

 

 (i). the transport of dangerous goods forbidden on passenger and/or cargo aircraft where the Technical Instructions state that such goods may be carried with an approval; or

(ii)other purposes as provided for in the Technical Instructions.

Note: In the absence of a specific reference in the Technical Instructions allowing the granting of an approval, an exemption may be sought.

– “Cargo aircraft” :- Any aircraft, other than a passenger aircraft, which is carrying goods or property.

-“Consignment”:- One or more packages of dangerous goods accepted by an operator from one shipper at one time and at one address, receipted for in one lot and moving to one consignee at one destination address.

– “Crew member”:- A person assigned by an operator to duty on an aircraft during a flight duty period.

– “Dangerous goods”:- Articles or substances which are capable of posing a risk to health, safety, property or the environment and which are shown in the list of dangerous goods in the Technical Instructions or which are classified according to those Instructions.

-“Dangerous goods accident”:-An occurrence associated with and related to the transport of dangerous goods by air which results in fatal or serious injury to a person or major property or environmental damage.

-“Dangerous goods incident”:-An occurrence, other than a dangerous goods accident, associated with and related to the transport of dangerous goods by air, not necessarily occurring on board an aircraft, which results in injury to a person, property or environmental damage, fire, breakage,spillage, leakage of fluid or radiation or other evidence that the integrity of the packaging has not been maintained. Any occurrence relating to the transport of dangerous goods which seriously jeopardizes the aircraft or its occupants is also deemed to constitute a dangerous goods incident.

– “Designated postal operator” :- Any governmental or non-governmental entity officially designated by a Universal Postal Union (UPU) member country to operate postal services and to fulfil the related obligations arising from the acts of the UPU Convention on its territory.

Requirements For Transport Of Dangerous Goods By Air

Approval To Transport Dangerous Goods

-No operator may transport dangerous goods unless given an approval to do so by the Authority in accordance with this Part and the Technical Instructions.

– Each operator shall comply with the provisions contained in the ICAO Doc 9284, Technical Instructions for the Safe Transport of Dangerous Goods By Air hereinafter referred to as “Technical Instructions”, on all occasions when dangerous goods are carried, irrespective of whether the flight is wholly or partly within or wholly outside the territory of Nigeria.

– To obtain the approval to transport dangerous goods, the operator shall in accordance with the technical instructions establish operating procedures to ensure the safe handling of dangerous goods at all stages of air transport, containing information and instructions on: the operator’s policy to transport dangerous goods; the requirements for acceptance, handling, loading, stowage and segregation of dangerous goods; actions to take in the event of an aircraft accident or incident when dangerous goods are being carried; the response to emergency situations involving dangerous goods; the removal of any possible contamination.

Exemptions

-Where specifically provided for in the Technical Instructions, if Nigeria is the state concerned, the Authority may grant an approval provided that in such instances an overall level of safety in air transport which is equivalent to the level of safety provided for in the Technical Instructions is achieved.

– In instances of extreme urgency or when other forms of transport are inappropriate or when full compliance with the prescribed requirements is contrary to the public interest, the Authority may grant an exemption from the provisions of the Technical Instructions provided that in such instances every effort shall be made to achieve an overall level of safety in air transport which is equivalent to the level of safety provided for in the Technical Instructions.

-In case that Nigeria is the State of overflight, if none of the criteria for granting an exemption are relevant, an exemption may be granted by the Authority based solely on whether it is believed that an equivalent level of safety in air transport has been achieved.

Technical Instructions

-Any person who performs, intends to perform or is required to perform any functions or activities related to the transport of dangerous goods by air shall comply with the provisions contained in the Technical Instructions.

 

-Each operator shall comply with the provisions contained in the Technical Instructions on all occasions when dangerous goods are carried, irrespective of whether the flight is wholly or partly within or wholly outside the territory of Nigeria.

– Where dangerous goods are to be transported outside the territory of Nigeria, the operator shall review and comply with the appropriate variations noted by Contracting States contained in Attachment 3 to the Technical Instructions.

Notifications of More Restrictive Requirements Adopted By Operators

-An operator shall notify the authority when it adopts more restrictive requirements than those specified in the Technical Instructions. 

-The authority will ensure that when the operator adopts more restrictive requirements than those specified in the Technical Instructions, the notification of such variations are made to ICAO for publication in the Technical Instructions.

Surface Transportation

-Dangerous Goods intended for surface transport and prepared in accordance with the ICAO Technical Instructions shall comply strictly with the Authority’s procedures for Air transport of Dangerous Goods.

Civil Aircraft Operations

-No Operator shall handle or transport Dangerous Goods by Air without adhering to the provisions of this regulation as well as the Technical Instructions for the safe transport of Dangerous Goods by Air.

– Where an Operator adopts more restrictive operating guidelines, the  operator shall be assessed based on those restrictive guidelines which will be incorporated in the Technical Instructions.

Limitation on the Transport of Dangerous Goods By Air 

Dangerous Goods Permitted For Transportation By Air

-The transport of dangerous goods by air shall be forbidden except as established in the regulations and the detailed specifications and procedures provided in the Technical Instructions.

Dangerous Goods Forbidden For Transport By Air Under any Circumstances 

-Articles and substances that are specifically identified by name or by generic description in the Technical Instructions as being forbidden for transport by air under any circumstances shall not be carried on any aircraft.

Dangerous Goods Forbidden For Transport By Air Unless Exempted 

-The dangerous goods described hereunder shall be forbidden on aircraft unless exempted by the States concerned under the provisions of the NCAA Regulations or unless the provisions of the Technical Instructions indicate they may be transported under an approval granted by the State of Origin:

1) dangerous goods that are identified in the Technical Instructions as being forbidden for transport in normal circumstances; and

2). infected live animals;

3) weapons and ammunition;

4). explosives, unless required on board the aircraft for it operations;

5). poisonous gases;

6). infectious substances; and

7). radioactive material, radioisotopes and similar substances.

Operator Exceptions

– Articles and substances which would otherwise be classified as dangerous goods but which are required to be aboard the aircraft in accordance with the pertinent airworthiness requirements and operating regulations, or for those specialized purposes identified in the Technical Instructions, shall be excepted from the provisions of this Part.

– Where articles and substances intended as replacements for those described in the paragraph above or which have been removed for replacement are carried on an aircraft, they shall be transported in accordance with the provisions of this Part except as permitted in the Technical Instructions.

Passengers & Crew Exceptions 

-Specific articles and substances carried by passengers or crew members shall be excepted from the provisions of this Part to the extent specified in the Technical Instructions.

Tinubu Launches N25,000 Conditional Cash Transfer to 15m Vulnerable Nigerian Households

The federal government of Nigeria has kicked off the disbursement of cash transfer to selected Nigerian households as part of efforts to ameliorate the impact of fuel subsidy removal.

The initiative, dubbed Renewed Hope Conditional Cash Transfer, was launched on Tuesday by President Bola Tinubu weeks after the federal government reached an agreement with organized labor unions to avert their proposed nationwide strike.

The launch of the conditional cash transfer for 15 million households coincided with World Poverty Eradication Day and was held at the Press Gallery of the State House in Abuja.

George Akume, the Secretary to the Government of the Federation, stood in for the President at the occasion.

Present were Betta Edu, the Minister of Humanitarian Affairs and Poverty Eradication; Wale Edun, the Minister of Finance; Shubham Chaudhuri, the Country Director of the World Bank; and Matthias Schmale, the United Nations Resident and Humanitarian Coordinator for Nigeria, along with other distinguished guests.

The cash transfer initiative aimed at assisting vulnerable citizens was first unveiled on October 1, during Tinubu’s inaugural Independence Day address to the Nigerian people on October 1.

Tinubu approved the payment of N75,000 to 15 million households, representing 62 million Nigerians, at N25,000 per month, for a three-month period from October-December 2023.

As part of measures to cushion the effect of fuel subsidy removal, the president also announced N35,000 only as a provisional wage award for all treasury-paid federal government workers for six months.

The Minister of Humanitarian Affairs said besides the unconditional cash transfer, another scheme code-named ‘Iya Loja Funds’ would be launched to provide soft loans of N50,000 to support petty traders. This, people say, is not different from trader-moni, a similar scheme introduced by Tinubu’s predecessor, Muhammadu Buhari.

Furthermore, Edu mentioned that as the upcoming farming season commences, farmers will receive incentives to enhance their agricultural productivity.

Nevertheless, there is significant apprehension among many regarding the government’s capacity to distribute cash transfers effectively, as there exists no dependable database to serve as the foundation for this initiative. However, Nigeria’s Finance Minister and the Coordinator of the Economy said a biometric auditing system would be put in place to ensure efficiency and accountability in the disbursement of the funds to beneficiaries.

The World Bank, which relentlessly urged Nigeria to remove fuel subsidy, has been an ardent supporter of the cash transfer initiative, providing an $800 million loan to the federal government earlier this year for that purpose. The Country Director of the World Bank, Chaudhuri, said his organization will continue to support the scheme.

Interrogating Omokri’s Thesis on Bridging the Skill Gaps in Nigeria

As usual with him, Mr. Reno Omokri has thrown another jab at the Nigerian University System. This time around, his target was the Nigerian educational system. He handpicked some courses and condemned them as useless because, according to him, those courses do not offer any skills or employment value after graduation. He charged:

Instead of spending four years reading a course like sociology, philosophy, anthropology, political science, library science and so on at university! Just go and learn a high income skill like nursing, cloud computing, blockchain engineering, artificial intelligence, web design, coding, programming, ethical hacking, and analytics! Between six and eighteen months. You will earn more in a lifetime than most university graduates. The world has changed. Many university courses have expired. They belong in a museum. Maybe a few people can read them to preserve some knowledge, But when you have hundreds of thousands studying them at degree level, they will never find real life applicable jobs for those degrees. And they and their courses end up being a drain on society. Get a skill instead of a semi-useless degree! And stop looking for loopholes. Those courses are dead and gone. They are like aerial cameramen. You cannot streamline an aerial cameraperson to compete with a drone. Accept reality and make better educational choices, and stop putting good money behind lost causes. Truth is bitter, but better!

This outburst had gone viral and sparked the usual conversation around how unemployable Nigerian graduates are and the need to change the downward movement of values accorded to Nigerian tertiary education certificates. Sadly, his thesis is partially and bitterly true. What is true is the fact that those courses are not really equipping students with the in demand job skills, both soft and hard, and especially digital skills to make them relevant to the reality of the workplace and society today. However, it is equally truer that the courses he mentioned are not the only ones in trouble. Almost all the courses offered in Nigerian universities except for few are in this category. From Mass Communication to Computer Science to Economics, the story remains the same.

What is not true is that the courses are useless or dead. It is the way they are being taught or floated in Nigerian universities that has made them appear so.   For example, I checked the Department of Sociology at Harvard University, what I saw amazed me. The welcome page shows an understanding of the reality of the present era. The opening reads:

The Department of Sociology at Harvard has a rich and varied history. Its faculty are deeply committed to the development of sociological theory in the service of addressing fundamental sociological questions about the empirical world. The Harvard department of the 21st century is characterized by unsurpassed methodological breadth and depth, with faculty and students engaged in a variety of approaches to research including surveys, ethnography, in-depth interviews, big data, social demography, causal inference, and historical archival work. Deep engagement with central social issues in the American landscape such as racial inequality, gender discrimination, violence, and mass incarceration is coupled with expertise in political, economic, and social and cultural issues in other parts of the world such as Latin America, Asia, and Europe. We invite you to explore sociology at Harvard.

I also visited the Oxford University’s Department of Philosophy’s web page. I marveled at what the university has made of philosophy, a course that Omokri pronounced completely dead in Nigeria. Oxford combined philosophy as a subject with other relevant subject matters. So, if you want to study Philosophy at Oxford, you have a range of options to select from: Computer Science and Philosophy; Mathematics and Philosophy; Philosophy and Modern Languages; Philosophy, Politics and Economics; Philosophy and Theology; Physics and Philosophy as well as Psychology, Philosophy and Linguistics.

If these two universities are considered to be in the global North and are leading global institutions, what of the Department of Politics Studies in the University of Witswaterstrand. On the page, I was particularly impressed by the claim of the department that:

The study of politics has traditionally been concerned with the relations between the state and its subjects. While these remain important, the scope of political studies has broadened to include: Associations such as business corporations; Development; Gender;Identity politics;Political parties; Power relations; Public Policy; Social movements; Trade unions and labour relations”

What my voyage to these three universities confirms is the fact that the courses listed in Omokri’s career advice are neither dead nor useless. The Nigerian universities have to change the mode, curriculum and the focus of these courses. There is an urgent need to deliver these courses in such a manner that the graduates would be equipped with skills that solve societal problems. The Nigerian University System has to find a way to manage the pool of talents on the campuses in order to stop the barrage of criticism of the Nigerian graduates are not employable. There is a list of other urgent reforms that should take place to make Nigerian universities more productive and impactful in educating the students of today.

Creative Implementation of the new CCMAS

The Core Curriculum Minimum Academic Standards (CCMAS) is the new curriculum that universities in Nigeria should kick-start its operations in the 2023/2024 academic session. This new document has come to gradually replace the old Benchmark for Minimum Academic Standards (BMAS). The curriculum has a number of new features for university education in Nigeria. It has expanded the number of faculties run by the universities from 14 to 17 with the unbundling of 3 courses to make them faculties. Apart from this, the new curriculum also changes the architecture of entrepreneurship with the introduction of innovation and ventures management as well as stipulating contemporary employability skills for each faculty and department. So, it is a new dawn for the Nigerian education system. However, it is important to understand that the curriculum is just a document. We have seen its richness in content, but its success and impact is dependent on how well it is implemented. Therefore, the operators of the Nigerian universities have to find a way to creatively implement the curriculum to address the current gaps.  The challenge now is how to teach innovation and venture management to spark change. How do teachers, who are the final implementers of the curriculum, teach the courses to reflect the current employability skills as captured?

For keen and concerned observers, the current entrepreneurship curriculum taught in the Nigerian University System is not reflective of the needs of the country. According to the scholar of entrepreneurship, subsistence venture creation is “the development of entrepreneurs who primarily focus on meeting their basic needs and those of their families. Their main goal is to generate enough income to sustain their livelihoods selling Indomie Noodles and Puff-Puff, and they often operate in traditional or low-growth sectors.” On the other hand, the NUS should run a Productive High-Impact Entrepreneurship programme which aims to create innovative and scalable businesses that have a substantial impact on the economy and society. High-impact entrepreneurs often seek to address major market gaps or societal challenges and are driven by growth and expansion.

Create an Innovation Hub to Support the Startup Ecosystem

Nigerian universities should realize the importance of an innovation hub on their campuses.  Described as a physical space that brings together researchers, creators, and innovators to nurture ideas into industry-changing products and services, a well-run innovation hub on a campus would provide a platform for both researchers, students, creators and innovators to ideate, incubate, develop and accelerate their ideas.  While some universities could run their hubs on their own, others could partner with innovation companies like Opolo Global Innovation Limited with hubs in universities across Nigeria.
