His Lordship, Justice Inyang Ekwo of the Federal High Court sitting in Abuja on Monday, 20th of December, 2021 has nullified Senator Andy Ubah’s emergence as the flag bearer of the All Progressive Party (APC) in the Governorship Election held in Anambra State on November 6 2021 which Prof. Charles Soludo of the All Progressive Grand Alliance (APGA) was declared the winner.

It is his Lordship ruling that Senator Ubah record for ever participating in the November 6, 2021 Anambra gubernatorial election be wiped clean by Independence National Electoral Commission (INEC) and let it be deemed that he never indicated interest or participated in that electoral process.

What led to this:

It was his Lordship decision that the primary election which Senator Ubah emerged from as the flag bearer of the All Progressive Congress (APC) party was illegally conducted and therefore void and nullified. It is the court’s ruling that APC did not conduct a valid primary election from which Senator Uba claimed to have emerged as the party’s candidate.

This case went to court when Mr. George Moghalu in June 2021 filed a suit at the Federal High Court, praying the court to out rule Mr. Ubah’s emergence as APC flag bearer and rule that the whole election process which he emerged from as the flagbearer of the APC was illegally conducted, the party having failed to conduct a valid and legitimate primary election. The court granted the prayers of Mr. George Moghalu and held that the emergence of Mr. Ubah was void and the whole election process was illegal.

In addition, the court ordered INEC to refund the sum of N22.5 million to Mr. George Moghalu which is the amount he paid for expression of interest and obtaining the nomination forms since the party failed to conduct a valid primary election.
