Is Nigeria’s Central Bank Governor legally qualified to join the 2023 Presidential race?

There are a plethora of political bigwigs that have so far indicated interests in the presidential race, despite every other contestant who has publicly declared or has shown an implied interest to join in the contest for the presidential seat, the CBN Governor, Mr. Godwin Emefiele’s interest came as a shock to everyone.

It is astonishing because of the post he is currently occupying as the Chief Executive officer of the number one financial institution in Nigeria. He occupies a very sensitive position that by all ethical standards, he has no reason to belong to a political party or participate in partisan politics or indicate interest in any elective position until he has resigned or relinquished his position as the Governor of the central bank.

Aside from ethics, codes of conduct and morality, the question is; is there any extant law that prohibits Mr. Emefiele by the reason of the position he’s currently occupying as the Governor of the Central Bank of Nigeria from contesting for any elective post in Nigeria? 

First of all, it is in doubt that it is the fundamental human right of every Nigerian citizen to exercise his franchise; to exercise his right to vote and be voted for. Any and every person who has identified him or herself as a member of the Nigerian society and a party to this social contract has been armed by the provisions of section 40 of the constitution of the federal republic of Nigerian to the right to indicate interest, join a political party, participate in politics and contest for any elective post in so far as that individual is of the right age and he is of the right qualifications. 

Therefore, Mr. Emefiele’s been a Nigerian citizen before anything else is in every length and breadth of the law qualified to contest for any position in the country but the controversies arose out of his current status as an active public servant and not just a mere public servant of low cadre but someone who is occupying a sensitive position in the public service; the next question this brings to fore is; whether Mr. Emefiele as the CBN Governor is qualified to contest for the presidential seat whilst he is still retaining his position as the chief executive officer of the CBN?. 

To answer this question, the provisions of S. 9 and section 11 of the CBN act will come to the rescue. According to the provision of section 9 of the CBN act, 2020, The Governor and the Deputy Governors shall devote the whole of their time to the service of the Bank and while holding office shall not engage in any full or part-time employment or vocation whether remunerated or not except such personal or charitable causes as may be determined by the Board and which do not conflict with or detract from their full-time duties. To this effect, the Governor of the CBN or any of the deputies in the institution is thereby prohibited from joining or engaging in any other remunerated job including participation in active politics which will be a total distraction to them. The Governor by the provisions of this section is expected to resign if he has an interest in going into any other job or joining active politics.

Furthermore, section 11(3) of the same CBN act 2020 also provides that The Governor or any Deputy Governor should resign his office by giving at least three months’ notice in writing to the President of his intention to do so. By the implication of this statutory proviso, if the Governor is interested in politics he should resign by giving at least 3 months’ notice and not one month’s notice which applies to other public servants.

The Electoral act in the controversial section 84(12) provided that any political appointee who is interested in contesting for any elective post should resign three months before the election. This is the statutory provision that Mr. Emefiele through his lawyers went to court to challenge, arguing that this provision does not apply to him for the reason being that he is a public servant regulated by public service rules and not a political appointee.  Let us assume that the proposition of Mr. Emefiele in this regard is right to some extent that he is a public servant and not a political appointee and hence, the provision of s 84(12) cannot apply to his person, what about the provision of section 11(3) of the CBN Act which mandates the CBN Governor and the deputies to resign by giving three months notice. 

Truth be told that legally speaking there is no categorical express provision of the law that prohibits a person who occupies the position of the CBN Governor to not contest in an elective post but that person must abide by the rules of public service and the CBN act which mandates him to resign first before joining in active politics to avoid distractions and conflict of interest but to our utmost surprise, the CBN Governor has been swimming in the musky water of active politics since February 2021 as his ward chairman confirmed that this is when the governor officially registered to become a member of the APC 

The CBN Governor has breached every ethical rule of public service and such a person can not be said to be fit to become the president of over 200 million people. If he is very much interested in becoming the number citizen of the country as he has indicated he should not be too reluctant to resign or relinquish his current position which is the right thing to do as; it is the game of “go hard or go home”. 

Finally, Mr. Emefiele and his teaming supporters should also know that he is setting a bad precedent. We won’t be surprised if the INEC chairman decides tomorrow to join the presidential race without first stepping down from his position as the chairman of INEC; don’t you see how ridiculous the drift is, if care is not taken the country will finally end up in a state of comatose.

Arsenal vs Tottenham Match Poised To Be A Cracker

No doubt, the upcoming game between Arsenal and Tottenham Hotspur, fondly called “The North London Derby”, is going to be a cracker. Both teams are doing everything possible to ensure they finish in the top 4 position.

Lately, some of the premier league matches played have been quite intense with few teams trying to escape the relegation zone, some trying to make it into the top four position, while title contenders, Liverpool and Mancity are fiercely contending for the EPL title.

With Arsenal sitting in the fourth position with four points above Tottenham, who are in the 5th position, you can imagine how intense the game would be. Arsenal has missed out on the champions league competition for 5 years and will not want to jinx things at this moment, looking at how close they are to playing in the champions league.

A win from the gunners will see them seal their place in the champions league. Although such a win might likely not come easy for them knowing full well that Tottenham hotspur is also eyeing the top 4 position, and they will do everything possible to ensure they catch up with Arsenal and possibly displace them from their 4th position.

Both teams are currently in top form, which makes the game a very intense one. Recall that during the beginning of the season, Arsenal thrashed Tottenham hotspur by 3 goals to one. The Gunners dominated the game in both halves which saw them cruise past Tottenham.

Will, they will be able to replicate such? Let’s not forget that Tottenham had to hire the tactical genius Antonio Conte who took over the team and has greatly turned things around at the club, which has seen their performances improve. However, the gunners will head into the match full of confidence following their four consecutive wins in the league.

Meanwhile, Tottenham on the other hand are unbeaten in their last three matches and will obviously want to pay back over the last result of their meeting. Arsenal essentially has nothing to lose, but everything to gain.

A win, lose, or draw in this match will still see them have the upper hand in the race for the top four position, as they will have two matches left to play. But a win is really what they need, to seal their spot in the champions league to save themselves from unnecessary tension.

Looking at Totteham style of play, they are known to be deadly on the counterattack, but Arsenal’s coach, Mikel Arteta has revealed that he has a perfect game plan to stop Conte’s men from victory. Pundits have tipped Tottenham hotspur to emerge victorious at the North London Derby due to how they played against Liverpool, holding them to a 1-1 draw.

Should Tottenham win this one, it can spell doom for Arsenal, because Tottenham seems to have very easy fixtures after the Arsenal game. It is difficult to pick a winner between Arsenal and Tottenham, based on both teams’ recent form.

A look at their previous games played against each other, they have faced each other in six premier league matches since 2019, picking up two wins apiece, while the other two matches ended in draws.

Arsenal’s coach Mikel Arteta has described the North London Derby as the “defining moment” of their season, with his team on the brink of qualifying for the champions league. This is indeed Arsenal’s moment to get back to playing in the champions league after a long while, they can’t afford to jinx it after coming this far.

On Purchase of APC Presidential Forms for Jonathan for Nigerian Presidency

Editor’s Note: ‘Nigeria’s former president, Goodluck Jonathan, has rejected a presidential nomination form bought for him by a group from northern Nigeria. Mr Jonathan described the purchase of the form, ‘without his consent’ as an ‘insult.’ In a statement by his spokesperson, Ikechukwu Eze, Mr Jonathan also said he has yet to decide whether to seek re-election on the platform of Nigeria’s current ruling party, APC.’

A coalition of Northern groups, Monday, 9th May 2022, purchased the presidential Expression of Interest and Nomination forms of the ruling All Progressives Congress (APC) for Nigeria’s former President, Goodluck Jonathan.

It’s noteworthy that the erstwhile president is a member of the opposition party, the Peoples’ Democratic Party (PDP), on whose platform he served the country as president from 2010 to 2015, after the death of Umar Yar’adua until his defeat by the APC.

There have been speculations in the past weeks that Jonathan would compete for the ticket of the ruling APC despite not being a card-carrying member of the party.

Meanwhile, Jonathan’s membership in the PDP has also been a subject for debate in recent times. It was gathered he did not attend the national convention of the party in 2021. Though he has not officially declared his membership of the APC, his body language suggests he has developed a soft spot for the party.

In April, 2022, being last month, some groups protested at Jonathan’s office in Abuja, appealing to him to join the race. While responding to the groups, he told them to ‘watch out’.

He said, “Yes, you are calling me to come and declare for the 2023 presidency; yes, I can’t tell you that I am declaring, but the political process is ongoing. Just watch out.”

It’s worth noting that there has been controversy over the eligibility of Jonathan to contest for Nigeria’s presidency, due to the alteration to the 1999 Constitution.

Some legal luminaries and analysts had argued that Jonathan is not eligible by virtue of 137 (3) of the Constitution of the Federal Republic of Nigeria 1999 as amended, which provides as follows:

“A person who was sworn in to complete the term for which another person was elected as president shall not be elected to such office for more than a single term.”

It could be recalled that after the death of Yar’Adua in 2010, Jonathan was sworn in to complete his tenure. He was re-elected in 2011 but lost in 2015 to Muhammadu Buhari of the APC, who remains the incumbent president.

It is reported that, as at 10th May 2022, over 25 aspirants had purchased the presidential forms of the ruling APC.

However, the former present has reportedly rejected the Presidential Nomination and Expression of Interest forms bought for him by the Northern group. He described the purchase of the form ‘without his consent’ as an ‘insult’.

In a statement released by his spokesperson, Ikechukwu Eze, on Monday, Jonathan equally disclosed he was yet to decide whether to seek re-election on the platform of Nigeria’s current ruling party, APC.

“It has come to our notice that a group has purportedly purchased Presidential Nomination and Expression of Interest forms, of the All Progressives Congress APC, in the name of former President Dr. Goodluck Ebele Jonathan.”

“We wish to categorically state that Dr. Jonathan was not aware of this bid and did not authorize it. We want to state that if the former President wanted to contest an election, he would make his intentions clear to the public and will not enter through the back door.

“While we appreciate the overwhelming request by a cross-section of Nigerians, for Dr. Jonathan to make himself available for the 2023 Presidential election, we wish to state, that he has not in anyway, committed himself to this request.

“Buying a presidential aspiration form in the name Dr. Jonathan without his consent, knowing the position he had held in this country, is considered an insult to his person. The general public is therefore advised to disregard it.” The statement read in parts.

Above all things and melodramas, my worry as a concerned Nigerian remains Jonathan’s continued interest to return as the country’s president. It’s, at this juncture, clear that he is nurturing a desire to contest for the 2023 presidential race, but the problem is apparently the party he would associate with.

Come to think of it; how could a certain interest group purchase presidential forms without the consent of the supposed beneficiary? This was exactly what transpired in the case of Godwin Emefiele, but the truth is gradually coming out.

I would candidly advise Jonathan, like I have done severally in the past, to honourably retire from active politics before he retires vulnerable. At his age and level in Nigeria’s political space, he ought to be able to read the handwriting on the wall.

I’m afraid, if Jonathan continues in this manner, or with this body language, he would definitely live to regret his actions as a person and as the country’s statesman.
